These Terms of Service ("Terms") govern your access to and use of the KŌINIsee mobile application and the KŌINIsee web portal (together, the "Service"). Please read them carefully. By creating an account, installing the app, or using the Service, you agree to these Terms.
The Service is operated by [LEGAL ENTITY NAME, as verified on Google Play], a company organized under the laws of the State of Michigan, United States ("KŌINI," "we," "us," or "our"). You can reach us at support@koini.io.
You must be at least 18 years old and able to form a binding contract to use the Service. By using the Service you represent that you meet these requirements. The Service is offered worldwide except where prohibited by law; it is not offered to residents of the State of Illinois, USA, and is not currently offered for use in jurisdictions where its features would be unlawful.
This section is important. KŌINIsee photographs people who use your device. You are solely responsible for using it lawfully. By using the Service, you represent, warrant, and agree that:
You are responsible for determining whether and how you may lawfully use the Service where you live. If you are unsure, seek your own legal advice before using it.
You access the Service by signing in with a Google account. You are responsible for keeping your sign-in credentials secure and for all activity under your account. Notify us promptly at support@koini.io if you believe your account has been compromised. Evidence stored in your account is accessible only to you when signed in; we cannot recover access if you lose control of the underlying Google account.
KŌINIsee is a paid subscription. Current plans are US$4.99 per month or US$39.99 per year, with a single tier that includes all features. A limited-availability lifetime plan may be offered during a launch promotion. Prices may vary by region and currency and may change over time; the price shown in the app or store at the time of purchase or renewal controls.
All purchases and renewals are processed by Google Play Billing, subject to Google's terms. We do not receive or store your payment-card details.
Subscriptions renew automatically at the end of each billing period unless you cancel at least 24 hours before the period ends. Your account is charged for renewal through Google Play.
You can cancel at any time in your Google Play account settings; cancellation stops future renewals and takes effect at the end of the current period. Except where required by law (see Section 11 for EU/UK consumers) or by Google Play's refund policies, payments are non-refundable and partial periods are not refunded.
How we handle photos and face data is described in our Privacy Policy, which is part of these Terms. In summary: face recognition for your trusted people runs on your device, and the mathematical templates ("embeddings") used for matching are stored encrypted on the device and are never uploaded. Only photos of unrecognized people are uploaded to your private account, encrypted. You can delete that evidence at any time, and deleting it in the Service deletes it on our servers.
You agree not to: reverse engineer, decompile, or tamper with the Service except where that right cannot lawfully be restricted; interfere with its security or operation; resell or redistribute the Service; or use it for any unlawful purpose or in any way prohibited by Section 3. We may suspend or terminate access for conduct that breaches these Terms or that we reasonably believe is unlawful or harmful.
KŌINIsee is a best-effort deterrent and evidence tool, not a security guarantee. You acknowledge and accept that it may fail to capture a photo or an alert, including when: the camera is covered, obstructed, or facing away; lighting is poor; the phone is face-down; the person is masked or at a steep angle; the device's operating system or manufacturer battery-optimization settings suspend the app's background service; required permissions are revoked; the device is offline; or a watched app is opened and closed faster than the camera can respond. Face matching is probabilistic and may produce false matches or false alerts. The Service is not a substitute for device passcodes, app locks, insurance, law enforcement, or your own security practices.
To the fullest extent permitted by law, the Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, error-free, or that it will detect or capture any particular person or event. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.
To the fullest extent permitted by law, KŌINI and its owners, officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, assets, profits, or goodwill, arising out of or relating to your use of or inability to use the Service, a failed or missed capture or alert, or unauthorized access to your account — even if advised of the possibility. Our total aggregate liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the twelve months before the event giving rise to the claim, or (b) US$50. Nothing in these Terms limits liability that cannot be limited by law, including the mandatory rights of consumers described in Section 11.
If you are a consumer in the EU, EEA, or UK, you have mandatory legal rights that these Terms do not override:
We may modify the Service or these Terms from time to time. If we make material changes, we will provide reasonable notice (for example, in the app or by email). Changes take effect when posted unless stated otherwise. Your continued use after changes take effect means you accept the updated Terms; if you do not agree, stop using the Service and cancel your subscription.
These Terms are governed by the laws of the State of Michigan, USA, without regard to its conflict-of-laws rules, except (a) as provided in Section 11 for consumers in the EU, EEA, and UK, and (b) where your local law requires otherwise. Subject to those exceptions, you agree that the state and federal courts located in Michigan will have jurisdiction over disputes arising from these Terms or the Service.
You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access if you breach these Terms or if required by law or by our platform providers. On termination, your right to use the Service ends; provisions that by their nature should survive (including Sections 3, 9, 10, and 13) will survive.
